Officer's Report
The proposed works are relatively major so as to allow disabled access into the sunken gardens. The handrails for the proposed ramps will match the existing handrails. On balance the proposed works would not adversely affect the character and appearance of the conservation area.
The Disability Access Office does not object to the proposal but would prefer the ramps to be 120mm wide rather than 1m, although he is aware that the measurement shown is between the posts.
The Highways Division of the Department of Transport have commented that the visibility splays of 2 metres x 36 metres shall be provided at the new access with the Ballaragh Road. This comment is clearly a mistake when the application is for disabled access ramps in Loch Promenade.
I therefore recommend that planning permission be granted subject to conditions.
PARTY STATUS
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The comments from Disability Access Office are a Building Control Matter and not a material consideration, as such they should not be afforded party status in this instance.
In summary, it is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded interested party status:
