Paragraph 10 of the Town and Country Planning (Development Procedure) Order 2005 provides that an application for planning approval by the Department of Local Government and the Environment, or for the development of land in which the Department has a vested interest, or on land which is occupied or controlled by the Department, shall be referred to a person appointed for the purpose by the Council of Ministers and the above captioned application has been so submitted to and considered by the Inspector appointed for this purpose.
The Inspector having considered the matter has recommended that the application be approved. His report is attached for the determination of the Council of Ministers as required under paragraph 10 of the aforementioned Order.
Council is invited to recommend the approval or otherwise of planning permission in respect of this application by the Department of Local Government and the Environment.

1 I have the honour to report that I have examined the proposals set out above, under the provisions of Article 10 of the Town and Country Planning (Development Procedure) Order 2005. I inspected the site on Monday 9 June 2008. This report contains a description of the site and the proposal; a summary of the material submitted; and my assessment and recommendation.
2 The application site consists of land within the Jurby Industrial estate. The proposal entails minor amendments to the development previously approved by PA 07/01457B. In particular, the number of access points along the proposed estate access road would be reduced from 11 to 9 ; the proposed highway lighting would be reduced, now being confined to the junctions between the proposed estate road and the A10 and A14 roads; and a proposed soakaway would be relocated on land adjacent to the A10.
3 Planning application 07/01457/B sought approval for the creation of a new access road through the Jurby Industrial Estate, with new and upgraded accesses to the A10 and A14 roads. That development was approved by the Council of Ministers on 12 December 2007. The present proposal is for minor amendments to the scheme previously approved.
4 The application site is located within land that is designated as an airfield under the 1982 Development Plan Order. Part of the site is also within a wider area of land that is classified as being of high landscape or coastal value and scenic significance.
5 No significant harm would arise from the amendments now proposed. It is recommended that the application be approved, subject to the following conditions:

1 The development hereby permitted shall commence before the expiration of 4 years from the date of this approval.
2 The approval relates to Drawings Nos 01 and C001 rev C date stamped 20 March 2008.
Other Submissions
6 The Department of Transport Highways Division and the Jurby Parish Commissioners have each indicated that they have no objection to the application.
Inspector's Assessment
7 No objections have been made to the minor amendments now proposed to the scheme previously approved. I can see no reason why these amendments should not be approved.
Recommendation
8 I recommend that planning approval be granted, subject to the conditions suggested by the Planning Directorate, as set out in paragraph 5 above.
