The Site
The site represents the curtilage of The Albert Public House situated on the western side of Athol Street opposite the harbour in Port St. Mary. The building stretches from Athol Street to the rear lane, backed onto by properties fronting onto Queen Street, to the south west.
Planning Status
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Residential and on the draft Port St. Mary Area Plan of 2001 as Mixed Use.
Planning History
There has been a number of applications submitted in respect of this property, none of which are relevant in the consideration of this application.
The Proposal
Proposed here is the installation of a shelter for smokers, to be located within the car park associated with the property and within its curtilage. The shelter is a timber boarded structure with open sides and front.
Representations
Port St. Mary Commissioners and Department of Transport Highways and Traffic Division indicate that they have no objections to the proposal.

ASSESSMENT
The provision of a shelter for smokers will not affect the appearance of the property as it is a separate structure and being situated in the car park will be generally out of site from the passing public. There is no adverse impact from the shelter.
PARTY STATUS
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
