Officer's Report
The application is a re-submission of a previous planning permission which has subsequently lapsed. The applicant wishes to reinstate the permission so that they can carry out the works.
The Manx Bat Group has commented that the roof space is a long established roost for brown long-eared bats and that the removal of the chimney stack is highly likely to constitute disturbance of this roost, which would be contravene the provisions of the Wildlife Act 1990. The Group recommend that the applicant contacts the DAFF’s Wildlife and Conservation Office prior to the work being put in hand.
The proposal seems reasonable and unobjectionable. I therefore recommend that planning permission be granted subject to the same conditions as the previous approval..
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Wildlife and Conservation Officer of the Department of Agriculture, Fisheries and Forestry have both commented on planning matters and as such should be afforded party status.
Manx Bat Group does not have sufficient interest in the application site and therefore should not be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the removal of a chimney stack as shown in drawing number KS/01 and photograph date stamped 13th December 2007; Letter from the Department of Education Works Division dated 11th December 2007.
C 3. The void must be slated over using slates to match those on the existing roof.
C 4. The works may take place only after the end of August, and must be completed before the end of April; the roof space may not be entered other than during this period.
N 1. These requirements to avoid disturbing the bats which roost and breed within the brickwork of the stack below the roof line; the applicant is advised to consult the Wildlife and Conservation Officer of the Department of Agriculture, Fisheries and Forestry (tel.843109) before commencing any works.
