Officer's Report
The Site
The application site represents the curtilage of 20 Church Road, Port Erin. The property is situated on the southern side of the road with the front ground floor being occupied as a commercial premise. To the rear first floor elevation three existing windows look out over a substantial flat roof which is a feature of the terrace. A service lane runs to the rear of the properties.
Planning Status
The application site is located within an area identified as being Mixed Use by the Port Erin Local Plan (Planning Circular 12/90).
Planning History
The following previous planning applications are considered relevant in the assessment and determination of this application:
PA 02/02092/B sought permission for the change of use from retail to food takeaway, alterations to the shop front, and installation of an extraction flue on the rear flat roof. This application was withdrawn 6th March 2003.
PA 07/01823/B sought permission for the installation of French doors at the rear of the building providing access to the flat roofed area. This application was refused with the reason for refusal stating:
"The proposed double doors would allow the use of the flat roof area as amenity space which would result in overlooking of adjacent properties by users of the space. It would have an un-neighbourly and detrimental impact upon adjacent properties."
Representations
The Department of Transport Highways Division has not commented on this application. Port Erin Commissioners recommend approval. We have received no privately written representations in relation to this planning application.
The Proposal
This application seeks approval for the replacement of the middle first floor window located on the rear elevation, with double doors. However unlike the previously refused application (07/01823/B) this application includes the installation of metal railings to be fitted to the exterior wall. These would prevent access to the flat roofed area.
Assessment
The proposed alterations would have minimal visual impact being at first floor height and set back from the rear lane. The inclusion of a guard rail reduces the potential for overlooking as it would prevent access onto the roof area. It is therefore considered that subject to conditions this application should be approved.
Recommendation
It is recommended that the application be approved.

C 2. This approval relates to the plans and information Location Plan, Photograph and 1.7130-101-01 Rev A submitted and date stamped 18th December 2007.
C 3. The metal guard railings must be installed as shown by Drawing No. 1.7130-101-01 Rev A and retained thereafter.
N 1. The granting of Planning Permission for the French doors with protective railings does not imply or infer that the flat roofed area to the rear of the property is suitable to be used as amenity space.
