The Site
The site represents a small square piece of land situated on the inside (south) of the breakwater to the north west of Peel harbour and beach. On the site presently sits a small wooden kiosk from which teas, coffees, hot snacks and ice cream are served when the kiosk is open. The building has wooden shutters which seal the building when it is not operational.

The site lies within in an area designated on the Peel Local Plan as Public Open Space.

Proposed now is the replacement of the existing kiosk with a cavity-walled building attached to the adjacent public toilets. The new building will be flat roofed with overhanging parapet matching the existing adjacent building and finished in render with a concrete roof.
Representations
Society for the Preservation of the Manx Countryside and the Environment raise no objection to the application.
Peel Town Commissioners indicate that they have no objection to the application.
Manx National Heritage comment as custodians of Peel Castle and comment on the design of the extension and conclude that its impact will not be significant.
Department of Transport Highways and Traffic Division indicate that they have no objection to the application.
Assessment
The creation of larger and more substantial catering facilities in this position which is popular in the summer months and when there are events going on in the bay should be encouraged and there is no adverse visual impact from extending the toilet building as is proposed.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Society for the Preservation of the Manx Countryside and the Environment is not directly affected by the proposal and as such should not be afforded party status in this instance.
Manx National Heritage represent a statutory authority and raise matters which are material planning considerations and as such should be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2.
This permission relates to the erection of a replacement kiosk as shown in drawings 01P1, 02P1 and 03P2 all received on 11th October, 2007.
C 3. The materials and external finishes of the new kiosk must match those of the adjacent building.
