Refusal Decision Notice
Town and Country Planning Act 1999
Town and Country (Development Procedure) Order 2005
Mr & Mrs E Collister Lyngarth Beachfield Farm Lane Kirk Michael Isle of Man
In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr & Mrs E Collister Proposal: Approval in principle to erect a detached dwelling at:
- Land adjacent to
- Lyngarth
- Beachfield Farm Lane
- Kirk Michael
- Isle of Man
which was considered on 4th March 2008, for the reasons set out below.
Date of Issue: 5th March 2008 Murray House Mount Havelock Douglas
Deputy Secretary to the Planning Committee
Reason(S) For Refusal:
- The access serving the site is inadequate to safely or conveniently accommodate a further dwelling.
Note: in the consideration of the application for the property which is now Sunset View, this plot was shown as garden space for that dwelling and the Inspector noted in his conclusions that the traffic from this one additional dwelling would not adversely affect road safety. This latest application would further increase traffic using this road network.
This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
