In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

Reason(S) For Refusal:
- The proposed residential development of the application site represents unwarranted and unjustified development within a rural part of Onchan contrary to the presumption against such development that is set out by policy O/RES/P/22 of Planning Circular 1/2000 and Spatial Policy 5, General Policy 3, Environment Policy 1 and Housing Policy 4 of the Isle of Man Strategic Plan 2007. Furthermore, taking account of the land use designation of the application site the proposed residential development is also contrary to the protection of the woodland, the ecological interest and the watercourse. In this regard the proposal is contrary to the land use designation of the application site as defined by the Isle of Man Planning Scheme (Onchan Local Plan) Order 2000 Map No. 1 and policy O/NC/P/3 and O/NC/P/5 of Planning Circular 1/2000 and Environment Policy 3, Environment Policy 4 and Environment Policy 7 of the Isle of Man Strategic Plan 2007.
This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
