The site represents the curtilage of the detached dwelling Toronto Vale, Tynwald Road Peel. The property is situated set back from Tynwald Road being separated by a lane which provides access to the proposal site and other properties to the east, Holmcroft, Carn-Y-Greie and Croit-E-Ferish.
The site is identified by the Peel Local Plan as being within an area of Predominately Residential Use. The site is not within a conservation area however Toronto Vale is a traditional building built before 1921 that has retained its original features and represents a prominent property in this area of Peel. Planning Circular 1/98 The Alteration and replacement of Windows is considered to be relevant to the assessment of this proposal, particularly Policy 7 'Buildings in an Urban Setting' which states:
'In an individual building, or group of buildings, whose principal elevations are readily visible from the public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or the existing windows are not the originals, the preference will be for replacement windows in the said principle elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows.'
The following application is considered to be relevant in the consideration of this application:
Planning application 01/02300/B sought permission to construct an extension to the rear elevation of the dwelling. This was permitted 19th April 2002.
REPRESENTATIONS
Peel Town Commissioners have indicated no objection to this application. The Department of Transport Highways Division does not oppose this application.
We have received no privately written representations in relation to this planning application.
Proposed here is the replacement of the existing timber framed sliding sash windows on the front elevation, believed to be the originals with new timber framed sliding sash windows. The application form states 'all designs as existing'. This is considered to be important in the determination of this application as the existing windows display finely detailed glazing patterns to the upper portion of the sliding sash, the loss of which would be considered to be detrimental to the exiting dwelling and the surrounding area.
Whilst it may be possible to renovate the existing windows it is considered that their replacement with new timber framed sliding sash windows is acceptable as these are likely to offer improved levels of thermal efficiency. The proposal accords with the provisions as set out within Planning Circular 1/98 and it is considered that the proposed replacements will have a neutral impact upon this well preserved building provided that the replacements represent a faithful reproduction of the existing original windows.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the Location Plan, Window Details and Photographs submitted and date stamped 5th September 2007.
C 3. The replacement timber sliding sash windows must be the same as the original windows in all respects, including the detailed design specifically the frame sections of the upper sash as shown on the submitted photograph.
