1)EPARTMENT OF INFRASTRUCTURE MEMORANDUM To: Jennifer Chance, Development Control Manager From: Ian Brooks, Planning Officer Subject: Extension of time for PA 07/01527/B - Erection of dwelling with garage (Amendment to approved 05/92177/B), Land adjoining South Court, Ramsey Road, Laxey. Date: 20/10/11 Planning application number 07/01527/B was granted planning permission on 241h October 2007 subject to conditions. The planning permission expires on the 241h October 2011. The applicant's agent has requested that the approval be extended for a further two years. The reason for this request is that the applicant has had an application for an additional building on the site which delayed the development of detailed plans, but he is now in a position to proceed. The present application expires 24 1h October, which is too short a time to get the further approvals to begin work. If the permission is extended it would exceed the 4 year limit as set out in the Development Procedure Order. The reasons set out by applicant to justify the extension of time do not amount to being special circumstances to warrant an extension of the planning permission. Furthermore, the applicant has obtained planning permission (11/00143/B) for a private multi- purpose sports range within the site, which was granted on 24th August 2011. The case officer stated in his report for this application that "Based on discussions with the applicant it is understood that this approved dwelling is unlikely to be built and a revised scheme, taken account of the current proposal, is to be drawn up. It is considered there are now new material considerations that need to be taken into account i.e. can a dwelling be sited next to the private sports range as currently approved and whether the sports range would impact on the residential environment of the proposed dwelling. These matters need to be subject of greater scrutiny and should be assessed by means of a new planning application. I therefore recommend that the extension of time request be refused. 7 Sigiied... . The Drainage Division of the Department of Transport has assessed the above planning application and would like to submit the following comments to your Planning Committee:- No Objection in principle, subject to the following conditions:- The proposed dwelling must be connected to the public foul sewer in a manner acceptable to the Department of Transport Drainage Division and on terms and conditions, which must be agreed with the Division PRIOR to the commencement of any building works. All drainage works must conform to the requirements of the Department of Transport's "Manx Sewers for Adoption" and all necessary inspections! surveys [including CCTV] are to be carried out at the developer's expense. A communication fee will be payable to the Department of Transport in respect of this drainage connection. There must be NO discharge of surface water (including that from roofs and paved areas) from this proposed development to any foul drainage system(s) so as to comply with the requirements of the Department of Transport Drainage Division and the Sewerage Act 1999. It is noted that the surface water from the property is to be discharged via a soakaway. The use of soakaways are subject to Building Control approval and if this approval is not granted, the Drainage Division would not give permission for the discharge of surface water into the existing foul system and an alternative means of disposal would have to be sought. The applicant is required to provide the Drainage Division with the location of the soakaway, prior to starting on site, the soakaway must not interfere with the integrity of the public foul sewer.
