Officer's Report
The Site
The site represents the residential curtilage of an existing substantial dwelling which sits on the southern side of the estate road which leads from Main Road (A5) into a cul de sac of to clusters of houses, one - this one - slightly less dense than the other. The house is a large detached one with attached garage.
Planning Status
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Residential.
Planning History
Following the erection of the dwelling in the 1990s, a conservatory was added under PA 00/1271, the garage was enlarged under PA 99/0741 and a first floor extension added over the garage to provide additional living accommodation under PA 04/0410.
The Proposal
Now proposed is the conversion of the existing garage to a play room, extension above the garage in accordance with the previous permission and the erection of a new detached garage in the rear garden. Access to the new garage will involve extending the driveway widthways towards the estate road.
Representations
Department of Transport Drainage Division recommend a condition which requires that the surface water from this development is not directed to the foul sewer.
Malew Parish Commissioners indicate that they have no objection to the proposal.
Assessment
Whilst the erection of the garage increases the density of development on the plot, there is still a large back garden. The garage will be close to the side boundary of the property behind - York mews apartments, it is a single storey structure whose roof will project above the existing boundary fence and sloping away from it. There is also a large parking area in front of the house (which was full of vehicles when I visited).
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the erection of a detached garage and the conversion of the existing garage to living accommodation with extension above all as shown in drawings reference AT 879.1 and the site and location plans all received on 2nd July, 2007.
C 3. There must be no discharge of surface water to the main foul sewer.
