In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Laxey Village Commissioners Proposal: Creation of hard standing and construction of wood fenced corrals for the storage of green waste at: Old Turbine House Old Laxey Hill Laxey Isle Of Man
which was considered on 26th October 2007, for the reasons set out below.

REASONS FOR REFUSAL:
- As the proposed development represents the creation of external storage on the application site as part of a waste processing facility the assessment of the proposal is subject to the provisions of Waste Policy 1 of the Isle of Man Strategic Plan 2007. In respect of this policy the proposed development is unacceptable by reason that:
a) the planning application fails to demonstrate that there is an acknowledged need for the proposal in accordance with the approved Waste Management Strategy; b) the use of the application site for the external storage of waste would be visually detrimental to the area and therefore the amenity of local residents; and c) the use of the application site for external storage would have an unacceptable impact on the character and appearance of the Conservation Area.
- The proposed development will result in the external storage of waste on the application site which is within a Conservation Area. Such storage will be visually detrimental to the setting and appearance of the Conservation Area, and therefore contrary to the provisions of Environment Policy 22 of the Isle of Man Strategic Plan 2007 and Policy L/CRB/PR/4 of the Laxey and Lonan Area Plan Order 2005.
- Notwithstanding the first two reasons for refusal, the approval and subsequent use of the application site for the storage of waste would unacceptably increase the potential incidents of illegal fly tipping within the area. Such fly tipping would be detrimental to the amenity of the area.
This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
