Planning Appeal – Ap 0197 ### Statement Of Case For V & A HOWE ### Appendix 2 ## Assessment The applicant proposes in principle, the erection of a new dwelling in open countryside, not zoned for such purposes. The application form states that the application seeks “Approval in principle to erect a retirement dwelling in field No. 334470” however, in the letter in support of the application, the applicants agent states that “There is no doubt that he [the applicant] would qualify for consideration for an agricultural retirement dwelling within the terms of PC 3/88, however it is considered unnecessary to impose such a restrictive condition because the site is within the existing built development of the hamlet.” The application site is clearly located outside the area identified as Area of Predominantly Residential Use existing, in the 1982 Development Plan Order and as the applicants agent has requested that the application not be considered as a dwelling for a retired agricultural worker, the application is considered against the provisions of General Policy 3 an Housing Policy 4 of the adopted Isle of Man Strategic Plan. General Policy 3 states that “Development will not be permitted outside of those areas which are zoned for development on the appropriate Area Plan with the exception of: a) essential housing for agricultural workers who have to live close to their place of work; (Housing policies 7, 8, 9 and 10):” The application is therefore considered contrary to the policies contained with the Strategic Plan therefore as although the applicants agent has submitted a case for a retired agricultural worker, the fact that he requests that a condition not be attached restricting future occupancy, results in the application being considered as a new dwelling on land not zoned for such purposes. The applicant’s agent refers to Planning Circulate 2/92 and the Western Sector Plan. The Western Sector plan does not extend to this area, and Planning Circular 2/92 relates to area identified in such Sector Plans as being areas for further study. It is therefore considered that neither the Western Sector Plan, nor Planning Circular 2/92 are relevant to the consideration of this application. The proposal would extend the built development of Glen Maye outside the defined area for residential development as contained with the 1982 Development Plan order.
