Officer's Report
The Site
The site represents the curtilage of Rushen Primary School which is situated to the north east of Four Roads at the meeting place of Rushen, Port Erin and Port St. Mary.
Planning Status And Relevant Policies
The site is designated as Primary School on the Isle of Man Planning Scheme (Development Plan) Order 1982.
Planning History
There have been a number of applications in respect of this site, the most recent and relevant of this being PA 07/0253 and 0255 for covered waiting areas to serve various parts of the school site.
The Proposal
Now proposed is the modification of the later application to take account of the comments of the Manx Electricity Authority in respect of the existing electricity supplies within the site. Essentially the proposal seeks permission to relocate the shelter further from the existing electricity cable.
Assessment
The proposal has no adverse impact on the appearance of the site and will provide a welcome facility for those outside and in inclement weather. The comments from the Manx Electricity Authority and the Disability Access Officer should each be addressed by way of a note as they refer to issues which are not planning matters.
Party Status
The Manx Electricity Authority and Disability Access Officer raise issues which are not planning matters and as such should not be afforded party status in this instance.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1.
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2.
This permission relates to the erection of a covered waiting area as shown and described in drawings reference CAP/24 and -25 both received on 1st May, 2007.
N 1.
The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687687) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.
The applicant is also advised to contact the Manx Electricity Authority for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.

The applicant should ensure that the facilities are suitable for use by disabled persons and the advice of the Disability Access Officer is recommended in this respect.
