THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises the curtilage of a mid-terrace dwelling located at 19 Third Avenue in Onchan. The proposed development comprises of the creation of a vehicle hardstanding and associated access in the front garden of the dwelling.
Whilst the application site has not been the subject of any relevant previous planning applications a similar development at 13 Third Avenue was the subject of a previous planning application that is considered relevant to the assessment. Planning application, 03/01604/B, sought approval for the creation of a vehicle hardstanding and access in the front garden on 13 Third Avenue. This previous planning application was initially considered and approved on the 9th January 2004, with the initial approval decision notice issued on the 12th January 2004. The Planning Committee resolved to confirm the approval at review on the 19th March 2004, with the review approval decision notice issued on the 25th March 2004. A subsequent appeal against the approval was dismissed by the Minister, in accordance with the recommendation of the appointed Planning Inspector, with the appeal approval issued on the 28th July 2004. Copies of the decision notices for this previous planning application have been placed on the file for the current planning application.
Onchan District Commissioners recommend that the planning application be refused on the grounds that the loss of the whole garden to parking. They advise that their recommendation is without prejudice to the use of up to 50% of the garden.
The Department of Transport Highways Division do not oppose the planning application subject to the imposition of a condition relating the installation of drop curbs.
The application site is within an area recognised as being within predominantly residential use under the Onchan Local Plan. Policy O/RES/P/21 of the written statement (Planning Circular 1/2000) that accompanies the Onchan Local Plan states:
"Extensions and alterations to existing residential property will generally not be opposed where such proposals are appropriate in terms of scale, massing, design, appearance and impact on adjacent property."
Based on a site visit it is apparent that car parking provision within Third Avenue is a clear and obvious problem. As such the applicant's reasoning for the proposal is readily understandable. The acceptability of the provision of vehicular hardstanding in the front garden of properties in Third Avenue has already been examined through previous planning application 03/01604/B. As stated earlier that previous planning application was approved initially, approved at review and confirmed approved at appeal. There are parallels between that previous planning application and the current one that lead to the conclusion that this current application is acceptable. Given the existing appearance of Third Avenue it is considered that the actual visual harm to the street scene would be limited.
It is recommended that the planning application be approved.
It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:
Onchan District Commissioners; and The Department of Transport Highways Division.
