Strategic Aim
Requires directing development to sustainable locations while protecting countryside. Officer found proposal conflicts as it introduces housing to undesignated rural land without justification.
Strategic Policy 1
Development must optimise previously developed land and utilise existing infrastructure. Site is rough curtilage land in countryside, not optimised brownfield, and extends ribbon development.
Strategic Policy 2 - Priority for new development to identified towns and villages
New development primarily in towns/villages or urban extensions; countryside only in exceptional cases per para 6.3. No exceptional circumstances demonstrated.
Strategic Policy 10
Promotes integrated transport minimising car journeys. New access proposed but site remote from services.
General Policy 3
Prohibits development outside zoned areas except specific exceptions (e.g. ag housing, conversions, replacements). Proposal fits none; tested as new open market dwelling in curtilage.
Environment Policy 1
Protects countryside/ecology unless overriding national need with no alternative. Uplands area with open moorland/skyline; development adversely affects without justification.
Housing Policy 4
New housing primarily in towns/villages; countryside only for ag housing, conversions, replacements. Proposal is additional dwelling, not exceptional.

The original planning application 11/00473/A sought approval in principle for the erection of a dwelling and was refused by the Department of Infrastructure. Mrs Vivien Claire Hoskisson appealed the refusal on 19th July 2011, requesting written representations procedure with a site visit. The Planning Appeals Office issued a notice on 20th July 2011 requesting statements from parties by 10th August 2011. The appeal was withdrawn by the appellant prior to any decision, as notified on 18th August 2011. Consequently, the original refusal stands. No inspector's analysis or decision was issued.
Precedent Value
This appeal sets no precedent as it was withdrawn before any substantive consideration or decision. Future applicants should ensure appeals are only pursued if there are strong grounds, as early withdrawal preserves the original refusal without inspector's input.
