The application site comprises the curtilage of a detached dwelling and adjoining land that is located on the northern side of a lane that leads off Ballaragh Road in Lonan.
The proposed development comprises of the erection of a summerhouse on the application site.
Whilst the application site has been the subject of previous planning applications it is considered that none of these are specifically material to the consideration of this current planning application.
REPRESENTATIONS
Lonan Parish Commissioners recommend that the planning application be refused. The grounds for their objection can be summarised as concern regarding the size and use of the proposed summerhouse and the detrimental visual impact caused by the excessive distance from the dwelling to the proposed summerhouse.
Under the Laxey and Lonan Area Plan Order 2005 the application site is part designated as open space and part designated as open space (private woodland or parkland, glens and plantations). Specifically, the curtilage of the dwelling is designated as open space and it is considered reasonable to describe the dwelling as a property located within the open countryside. The adjoining land is designated as open space (private woodland or parkland, glens and plantations). The entire application site is located within a wider area of land that is designated as being of high landscape value and scenic significance.
Policy L/OSNC/PR/1 of the Laxey and Lonan Area Plan Order 2005 states:
"There will be a general presumption against development in areas designated as open space or open space for particular purposes."
Whilst part of the application site, and that which accommodates the proposed summerhouse, is designated as woodland under the local plan it is clear from a site visit that the extent of the existing trees is somewhat short of being able to be called a true woodland. Although the planning application states that the proposed summerhouse is located within the garden of the dwelling this is questionable as that part of the application site appears to be located outside of the natural residential curtilage of the dwelling. Notwithstanding this, in terms of the proposed development it is considered that the siting of the proposed summerhouse is too far removed from the dwelling and that it represents encroachment into the countryside. No reason is given within the planning application for the chosen siting and it appears quite possible to site the summerhouse closer to the dwelling in a more appropriate position. The effect of the proposed siting is that the summerhouse will appear detached and encroach into the countryside to the detriment of visual amenity. It is recommended that the planning application be refused on these grounds and on the basis that the proposed development is contrary to the provisions of policy L/OSNC/PR/1 of the Laxey and Lonan Area Plan Order 2005.
It is considered that all parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status.

By reason of its location within the application site and the distance of the proposed summerhouse from the existing dwelling it is considered that the proposed summerhouse will appear as a detached structure that encroaches into the countryside to the detriment of visual amenity. As such the proposal is deemed to be contrary to the provisions of policy L/OSNC/PR/1 of the Laxey and Lonan Area Plan Order 2005.
