Re: Browns Indian Cuisine, First Floor 2 Dumbells Terrace, Laxey Variation of condition of original restaurant use application 00/00195/B to allow extended restaurant business hours till midnight.
We the owner occupiers of 4 Dumbells Terrace wish to object to the proposed extended business hours to the above. We feel that this would produce further unwanted and unacceptable levels of noise and nuisance to our residential area into the early hours of the morning.
This concern has been shared by Laxey Village Commissioners and the Isle of Man Constabulary Community Safety Unit, who supported the condition to restrict business hours to 10pm each day. It would appear that the Planning Committee also showed their concerns by imposing the condition and as the residential use of the area has not changed we hope that the condition will remain in force.
As reported to the Planning Enforcement Officer in March, the restaurant and takeaway currently operate on the basis that they can serve food up until 10pm resulting in noise and nuisance from customers and staff remaining on the premises until late into the evening /early morning especially at weekends. However the condition clearly states that the upper floor may not be used after 10pm on any evening and we would be grateful if the Enforcement Officer could ensure that this is adhered to if the application is unsuccessful or until such time that the business hours are extended.
