The site represents the domestic curtilage of an existing dwelling situated on the southern side of St. Mary's Road and to the north west of Baymount, thus having two frontages. The existing dwelling sits towards the rear of the plot. Vehicular access is directly from St. Mary's Road with a drive leading to a garage.
The site lies within an area designated on the Port Erin Local Plan as Predominantly Residential.
Planning permission has previously been sought and granted for the following developments:
PA 04/1257 - erection of a conservatory and<br/> PA 04/2485 - construction of a porch.
Proposed here is the erection of fencing around the perimeter or the front and side garden and the construction of a summer house in the front garden on the corner of Baymount and St. Mary's Road.
The garden has trees at its corner in front of which will sit the summer house and as such not being intrusive into the streets cene. The fencing is required to provide some safety for those in the front garden, particularly children as the road level is somewhat lower than the garden and within the garden the existing boundary wall is only around 0.5m in height. The proposed fencing, some of which has already been erected, is attractive and has a curved trellis effect top and is 1.2m in height. The house is elevated above the road and garden level and there is limited privacy for those in either the house or the garden.
Whilst the fencing will reduce the open aspect of the front garden, the streets cene is varied, with relatively dense tree planting on the other side and a winding street pattern. As such I do not consider that the fencing or summer house will cause any harm to the appearance or character of the area.
Whilst the Department of Transport has objected to the application on the basis that the fence will obscure the visibility of those in vehicles emerging from the site, visibility is already hampered by the existing gates which of course have to be open if one is to get out of the access. The fence should make no discernible difference to this.
I and the applicant have tried on a number of occasions to contact the Department of Transport to discuss this but there has been no response. On the basis of the applicant's allegation that there is presently limited visibility I recommend that the fencing should be permitted.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Whilst Manx Electricity Authority represents a statutory authority, the points raised in correspondence relate to working practices and not planning and as such should not be afforded party status in this instance.

C 1.
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
This permission relates to the erection of fencing and a summer house all as shown and described in the information, photographs and plans received on 23rd August, 2006.
The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687705) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.
The applicant is also advised to contact the Manx Electricity Authority for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
