The site represents the domestic curtilage of an existing modern property located on the south eastern side of Perwick Road at its southern end, before the road runs westwards towards Perwick House and Perwick Bay. The existing property is single storey as viewed from the estate road and as the site slopes downward in a south easterly direction, the rear elevation is two storey with steps leading to a lower garden level.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Existing Residential. On the draft Port St. Mary Area Plan the site lies within an area of Residential use.

Also proposed and has been partially undertaken is the blocking up of the two windows in the front elevation. It is proposed that these former apertures will be decorated with sculptures of an aquatic nature - fish, lily pads, lilies. The sculptor who is to undertake the work has also decorated some of the inside of the house and the applicant has provided illustrations of this.
The various amendments to the approved alterations and extensions are not significant in terms of their appearance or the impact on neighbouring properties from inter-visibility. Of the changes proposed, the only one which has generated objections is the decoration of the windows. Some of those living around the site are concerned that the appearance of the sculpture together with the lighting (a spot light over each window is proposed - not continuously illuminated) will be out of keeping.
The work is well under way and it was not possible for me to take useful photographs of the property due to the scaffolding which surrounds the building. However, the streetscape is characterised by a variety of house types and materials. One of the properties has a projecting gable with very small
windows facing the road which distinguishes it from its neighbours but to no detriment to the streetscene.
The blocking up of the windows and insertion of the artwork proposed will not affect the streetscene so adversely as to warrant refusal of this application. Many properties are individualised by their owners by the choice of materials, colour or decorative fixings and much of this is not subject to any planning control. The proposed works will produce an elevational feature which is different from that of the remainder of the streetscene but as most of the properties in Perwick Road are different from each other anyway, I do not consider this sufficiently different to warrant refusal of the application.
Whilst there may be lighting proposed, the applicant has indicated that this would not be illuminated continuously and in any case I would recommend that such lighting does not constitute development.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The occupants of 17, 18 and 19, Perwick Road, are all opposite the site and are in direct view of and have a direct view of the property and as such should be afforded party status in this instance.
Whilst Manx Electricity Authority and Fire Prevention Officer represent statutory authorities, the points raised in correspondence relate to working practices and Building Control matters and not planning and as such should not be afforded party status in this instance.

Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687705) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.
The applicant is also advised to contact the M.E.A. for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
