The site represents the curtilage of an existing residential property situated on the eastern side of Mourne View.
The site is designated on the Peel Local Plan as Predominantly Residential. The Peel Local Plan was adopted by Tynwald in 1989.
The residential development of which this site forms part, was approved in principle under PA 90/1182 and in detail under PA 91/0668.
Proposed here is the use of the driveway for the parking of an additional taxi. The Department's practice is that a taxi-driver may bring his own vehicle home and this does not constitute development. The parking of more than one vehicle however does constitute development and planning permission is required.
Department of Transport Highways and Traffic Division do not object subject to there being four off-street parking spaces provided off street (presumably two to cater for the taxis and two more for the occupant's own vehicles, should there be any.
Peel Town Commissioners raise no objection to the application.
The taxis to be parked at the property are both driven by the owners of the property and as such there would be no comings and goings by others. Effectively the application seeks permission for two people who live in the same property to bring their own work vehicles home. The application indicates that they will be parked there whilst not in use, overnight so there should not be any disturbance to neighbours. If this is the case there is effectively no material change of use of the property.
A similar case arose in King Edward Road, Onchan where an objection was received from a neighbour. This application, PA 04/2448 was refused at appeal due to the perceived nuisance to neighbours and the difficulty in distinguishing between parked taxis and those operating from the property with the comings and goings associated therewith. Similar applications were refused at Farmhill Park, Douglas (PA 04/0970), Honeysuckle Lane, Douglas (PA 04/1687). A third taxi was refused permission to be parked in St. Catherine's Drive, Douglas (04/1308) following approval of a second taxi (PA 04/0553). An application is presently pending consideration for the parking of a second taxi at Copse Hill, Douglas (PA 06/0466).
It would help if the applicant could clarify how much parking space there is on site and how many other vehicles they have. Also how the taxi business is operated is relevant: if they operate their own service or are on call there could be comings and goings which would affect the neighbours.
The applicant has provided more information regarding the amount of available parking space, vehicles and operation of the taxi business. He has explained that if approved, there will be only two vehicles parked at the premises as the existing family car will be replaced by the new taxi. The taxi business is in two parts, one vehicle operating to and from the airport, the other with a license for North and West and operate on a mobile telephone not a radio basis. They also point out that their property is not en route past other properties and as such, whatever comings and goings occur will not adversely affect other residential properties. This is a valid point and does distinguish this from other proposals for the operation of two taxis from one premises.
The property has a double garage and two spaces in front, thus complying with the Department of Transport's requirements.
Department of Transport Highways and Traffic Division and Peel Town Commissioners are statutory authorities and as such should be afforded party status in this instance.

C 1. This permission relates to the parking of one additional PSV on the driveway of "Tiz-I" as shown in the submitted plans. This permission does not authorise the operation of a taxi business from the premises.
C 2. This permission will remain valid for a period of four years within which the permitted use must be taken up in order for the approval to remain valid after this time.
