Officer's Report
The Site
The site represents land to the south east of Gelling’s Avenue which runs steeply uphill from Bay View Road and Cronk Road. The site has to its rear the car park associated with the local Baptist Church, to the north east lie the public toilets and to the north west are three relatively new terraced houses (approved under PAs 97/01896/A and 98/01877/B) and garaging to the south west which has permission for development for residential purposes (PA 05/92275/A).
Planning Status And Relevant Policies
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Residential. In the Port St. Mary Area Plan which proceeded as far as public inquiry, the site is within an area of Mixed Use where residential, industry, offices or retail would be considered acceptable land uses.
Planning History
Planning permission was granted for the change of use of the existing building as a food processing facility (frozen ready meals) under PAs 94/0190 and 94/0895. Recently planning permission was
granted for the redevelopment of the site for residential purposes in the form of 15 apartments with associated car parking and access provided to the church car park to the rear (PA 95/92112).
The Proposal
Now proposed is a modification of the most recently approved development in the form of the provision of a lift shaft terminal designed to look like a chimney and positioned on the rear pitch of the new roof. The structure would be finished in lead sheeting.
Also shown as slightly different on these drawings are the planted beds at the front of the site. These are to be stepped resulting in less high expanses of concrete alongside the footway.
Assessment
The proposal alters only slightly the approved scheme and the new feature does not have any adverse visual or other impact.
Party Status
The Manx Electricity Authority and Port St. Mary Commissioners are or represent statutory authorities and as such should be afforded party status in this case.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the addition of lift accommodation as shown in drawings reference 1029-02, -04C and -05C all received on 13th April, 2006. The development must be otherwise carried out in accordance with the terms and conditions of PA 05/92112.
N 1. There are underground cables/overhead lines present in the area of the application. As such the applicant/developer is advised to consult the MEA (tel: 687766) before any work is carried out.
