Officer's Report
The Site
The application site represents the curtilage of a building currently in use as a café on the corner of Athol Lane, and Michael Street, Peel.
Planning Status
The site is located within the Peel Conservation Area and in an area identified as mixed use in the Peel Local Plan.
Planning History
PA 04/02444 granted approval for the conversion of the building to a café/tea rooms, with PA 05/1855 granting approval for a change of use to enable tables and chairs to be placed on an extended paved area for use by café patrons during business hours.
The Proposal
This application seeks approval to form opening lights to create a serving hatch to the outside seating area and the installation of a foldaway awning to the front elevation onto Michael Street.
Assessment
The proposal is related to the previous application to enable tables and chairs to be placed on the pavement outside the café insofar as the serving hatches are identified to serve the outside eating area. In addition, the foldaway awning is proposed to provide shade to this area.
It is considered that subject to clarification as to the material of the foldaway awning, the application would further enhance the building which is in a prominent position with the Peel Conservation Area. Furthermore, it is considered that the serving hatches would not detract from the appearance of the building within the Conservation Area, nor impact adversely on the pedestrian activity on the adjacent pavement, given that permission has already been granted for the positioning of table and chairs in this location.
With regard to the opening lights, these would be positioned in the front (Athol Place) elevation, and be located either side of the two central window sections. The existing windows are constructed of timber, and it is considered that the proposal would not detract from the appearance of the building in the streetsceene nor the character of the Conservation Area.
Having discussed the application with the applicant, it would appear that they do not at this stage wish to proceed with the awning element of the application. I therefore consider that as it is considered that the awning is acceptable within the streetscenem it is appropriate to condition the material of the awning to the submission of details prior to the erection on site, a condition the applicant would be willing to accept.
Representations
The Department of Transport Drainage Division advise of no objection subject to a condition relating to the height of the proposed awning.
Peel Commissioners recommend that the application be approved.
Party Status
It is considered that those who made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to Drg. No. 00417/1 dated 10/03/06 and submitted as part of this application.
C 3. Prior to the erection on site, details of the material of the proposed awning must be submitted for approval by the Planning Authority.
C 4. The opening lights to the front elevation must be constructed in materials to match the existing windows.
