The Site
The site represents a field located on the northern side of the B30 Bayrauyr which links St. Mark's with the Ballamodha Straight (A3). The site has on it a greenhouse and has been the subject of the application for the conversion of the barn across the road to living accommodation where the car parking for the barn will be provided on this site. (PA 05/01702). The site has on it various trees.
Planning Status
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as "white land", that is not designated for development.
Planning History
No applications are recorded for this site, however part of it did form part of the application for conversion of the barn on the southern side of the road (proposed by this applicant) - see above.
The Proposal
Proposed here is the principle of the erection of one dwelling on the site. The site is of not inconsiderable size - 55m frontage to the B30 and around 55m deep. The application describes the proposed dwelling as "in the style of a traditional barn" and it is also suggested that a small holding will be created on the site.
Assessment
The site is not designated for development nor is it infilling a space in an otherwise developed frontage in a recognised settlement. As such there is a presumption against development here as set out in the Isle of Man Planning Scheme (Development Plan) Order 1982 and Planning Circular 1/88. Furthermore the applicant already has permission for the creation of a dwelling in the form of the conversion of the barn on the other side of the road (PA 05/1702).
There have been other proposals for development of new dwellings in this area - PAs 94/0094, 94/01275, 97/02070, 00/1041 and 04/2520 recently refused on appeal (see attached) - all refused. One dwelling has been permitted in principle for agricultural workers - PA 05/00512). Approval of this proposal would be unwarranted and would establish a precedent for further development outside undesignated areas and in an unsustainable location.
Party Status
Malew Parish Commissioners, MEA and the Department of Transport Highways and Traffic Division are all statutory authorities and as such should be afforded party status in this case.
Society for the Preservation of the Manx Countryside and the Environment are not directly affected by the proposal and as such should not be afforded party status in this case.

The site is not designated for development on the Isle of Man Planning Scheme (Development Plan) Order 1982. In addition, there have been a series of planning applications for development in this
area which have all been refused (PAs 85/0733, 89/1298, 90/1855, 92/0152, 00/1041, 04/2520). As such development of a dwelling in this location would be contrary to the provisions of the 1982 Plan and Planning Circular 1/88 and the policies of the emerging Strategic Plan which support these existing policies and aim to protect the countryside for its own sake. Such development would also be unsustainable as it is some distance from any substantial centre of population and services and it would establish an unfortunate precedent for further unwarranted development in the countryside.
