Dear Sir/Madam,
ON APPEAL: PA 02/1674 – J G Kelly Homes Ltd – Erection of a two, three and four storey apartment block comprising fourteen apartments with ground floor parking to replace Auto-Electrical Centre, garage and stores at Battery Pier, South Quay, Douglas.
I refer to the recent appeal hearing in respect of the above planning application.
In accordance with the provisions of paragraph 7(5) of Schedule 1 to the Isle of Man Planning Scheme (Development Plan) Order 1982, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.
I am directed to advise you that the Minister has considered the report, concurs with the appointed person’s conclusions, and accepts the recommendation that the appeal should be upheld. Accordingly, she has directed that the Planning Committee’s decision to refuse permission should be reversed, and that the application should be approved subject to the conditions set out in paragraph 59 of the report. Formal notice of this decision is attached hereto.

In pursuance of his powers under the above Acts and Order the MINISTER for Local Government and the Environment, following report by the appointed person, does hereby APPROVE the application by J G Kelly Homes Ltd for the erection of a two, three and four storey apartment block comprising fourteen apartments with ground floor parking to replace Auto-Electrical Centre, garage and stores at Battery Pier, South Quay, Douglas subject to compliance with the conditions or modifications specified on the attached schedule and numbered 1 - 3

- This approval relates to the proposed development as amended by the revised drawings (nos. 02/A, 03/A and 07/A) received on 11th March 2003.
- Precise details of all external finishes shall be submitted to and approved by the Planning Committee prior to the commencement of development.
- The development as hereby approved shall commence before the expiration of four years from the date of this notice.
