The original application for an extension to the caretaker's store within the ground floor of the covered car park at Fort Anne Offices, South Quay, Douglas was granted subject to condition 3 requiring replacement parking for spaces lost to the development, as recommended by the Highway Authority. The appellant argued that condition 3 was unreasonable and unnecessary, citing excess parking provision (171 spaces against a requirement of 121 based on prior standards of 1 space per 25 sq.m office floorspace) and underuse of the top deck. The Planning Authority and Department of Transport defended the condition, lacking evidence of surplus or impracticality of replacement parking. The inspector concluded that the appellant provided sufficient evidence of surplus parking under current Strategic Plan standards (1 space per 50 sq.m in town centres), rendering the condition unnecessary. The Minister accepted the recommendation, allowing the appeal and granting approval without condition 3 on 21 August 2006.
