1. Summary
The purpose of this report is to assess the likelihood of noise or odour nuisance from the proposed hot food take away at one of the retail units at Darnill’s Petrol Station, Station Road, Port Erin.
The external extraction unit is not specified in the planning application. There is no sound or odour attenuation information supplied in respect of the exhaust extraction but it is proposed to be located at least 20m from any residential premises.
There is an existing hot food take away at one of the adjacent units at Darnill’s Garage and I am not aware of any complaints in respect of odour or noise from any of these units in the last 2 years.
However, although odour control may be unnecessary I would recommend adequate dispersion of exhaust fumes to dilute their odour.
Consequently if planning is minded to approve this application I would recommend the following conditions:
The rating level of the noise emitted from the fan exhaust at Darnills Pizza Take-away Unit shall not exceed:
LAeq, 1 hour – 45 dB between 0700 – 2300 hrs, and LAeq, 1 hour – 35 dB between 2300 – 0700 hrs at the façade of any noise-sensitive premises.
Measurements and assessment shall be made according to BS 4142:1997 ‘Method for rating industrial noise affecting mixed residential and industrial areas’.
N.B. Given the nearest façade of the nearest noise-sensitive premises is 20m these limits would approximately correlate to levels of; LAeq, 1 hour – 60 dB @ 3 metres from the exhaust between 0700 – 2300 hrs, and LAeq, 1 hour – 50 dB @ 3 metres from the exhaust between 2300 – 0700 hrs.
In respect of odour the extraction unit shall not cause any harm to the amenity of local residents and discharge the extracted air not less than 1m above the roof ridge of Darnills Garage.
If there are planning concerns in respect of the visual appearance of such a duct an exhaust to the roof ridge height of Darnills Garage may be sufficient. Otherwise further to justified complaints of odour nuisance the local authority could require odour control works.
