Officer's Report
The application proposes the installation of timber casement windows to replace the existing windows on the front elevation of flat 4 at Ballure House, 29 Brunswick Road, Douglas which is south of Albany Road. The property is part of a row of eight terrace properties, which this property is one of the end terraces. The site is located within the Selbourne Drive Conservation Area and is zoned within a predominantly residential area under the Douglas Local Plan Order 1998.
The property has had a recent Planning Refusal for the, installation of replacement uPVC windows to front first floor elevation on the grounds that, the site is within a Conservation Area which came into operation on the 1st of September, and the building is of architectural interest and attraction; in these circumstances, the existing windows should be refurbished, if practical, or, if necessary, replaced with wooden-framed windows which match the existing in all respects.
The Douglas Corporation have considered the application and have no objections. We have received nor privately written representations objecting to the application.
The new application has taken the previous refusal into consideration and after consultation with a Conservation Officer proposes the existing windows to be replaced (which are in a poor state of repair) with timber casement windows and to replace / repair the upper part of the chequer design coloured windows, so that the proposal will look exactly like the original windows / design. The rest of the property / flats (29 Brunswick Road) have still got the original windows so this is essential that the proposed replacement match the existing as well as other properties along Brunswick Road and the Conservation Area as a whole.
The proposals would seem to be appropriate in these locations as the replacement windows will enhance the architectural interest and attraction of the property and therefore conforming to the Conservation Area. My recommendation is for an approval.
A condition shall be added that the replacement windows must include the chequered coloured window design, as the submitted application is not entirely clear, however I have spoken to the applicant who has told me that they intend to replace / repair the chequered window as existing.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. The approval relates to the submitted documents which are date-stamped 2nd November 2005.
C 3. Planning Approval only applies with the inclusion of the replacement or repair of the chequered coloured window design above the timber casement windows to match as existing.
