Site / Proposal The application proposes the relocation of the existing oil tank to beyond the rear boundary wall at 11 Brunswick Road which is part of a row of terraced properties which has been zoned in an area of predominantly residential under the Douglas Local Plan Order 1998. The area is also within the Selbourne Drive Conservation Area. The proposal is to move the existing oil tank which is located in between the new single storey rear extension and the existing rear wall of the dwelling to the rear of the boundary, to within the rear lane (not adopted) with the erection of a screen around the tank which would be 1.8 metres wide, a projection into the rear lane of 0.9 metres and will have a maximum height of 1.4 metres. The applicant has stated that relocation of the tank is necessary due to progressive damp issues and safety reasons. The lane to the rear is used for oil tank delivers and for bin collection. ## Consultation The Douglas Corporation have considered the application have no objection. We have received a letter of objection from the residents of 3 Tennis Road although they sent the letter after the deadline for consultations. Their objections are the property does not belonging to the applicants and the reasons for this application is due to the recently built extension is too big for the rear yard and they should have taken the oil tank into consideration before. They note although the lane is not used as a thoroughfare, they use it on a daily basis. The lane is needed for oil deliveries in their rear yard and probably for a number of dwellings on Brunswick Road whose back yards also have access to the lane. ## Assessment / Recommendation The proposal would be built within land not owned by the applicants; however ownerships are not planning matters. The installation of the oil tank and screening around would cause an unwarranted precedent in the area and would have a detrimental affect upon the amenities of the neighbouring area. For these reasons the proposal would seem unacceptable in this location and therefore my recommendation is for a refusal (see appendix 1). I consider that the following meet the criteria of Government Circular 1/06 and should be afforded interested party status: The Douglas Corporation, Mr M G & Mrs S Burrons – 3 Tennis Road.
