In pursuance of powers granted under the above Act and Order the Department of Infrastructure does hereby REFUSE the following application made on behalf of:
Name: Ballakillingan Farm Limited Proposal: Creation of a campsite and alteration to entrance driveway at: Fields 134295, 134296 & 134297 Ballakillingan Farm Churchtown Ramsey Isle of Man
which was considered on 25th July 2011, for the reasons set out below. Date of Issue: 26th July 2011 Murray House Mount Havelock Douglas

Reason(S) For Refusal:
- The proposed use would have an adverse visual impact upon the quality and character of the countryside which is regarded as being of High Landscape or Coastal Value and Scenic Significance and would therefore be contrary to Environment Policy 1 and 2 of the Isle of Man Strategic Plan.
- The vehicular access onto the Lezayre Road would not provide the required visibility sprays in either direction and therefore would have an adverse impact upon highway safety not only for users of this access but also users of the public highway.
- As the site is identified as being an area of High Flood Risk, a flood risk assessment and details of proposed mitigation measures must accompany any application for planning permission. This information has not been provided and therefore the proposal would be contrary to Environmental Policy 10 and 13 of the Isle of Man Strategic Plan.
- Given the location of the sanitary accommodation within the centre of the working farm complex it is considered this would result in a user conflict between visitors to the
campsite and farm operations which would be detrimental to the wellbeing and safety of visitors.
This decision was made by the Director of Planning and Building Control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
