General Policy 3
Permits development outside zoned areas exceptionally for 'building and engineering operations which are essential for the conduct of agriculture or forestry' (f). Officer found proposal met this test on fine balance due to evidenced need for equipment/feed storage despite new farm, tipping balance against general countryside restrictions.
Environment Policy 1
Protects countryside for its own sake unless overriding national need outweighs protection with no alternative. Agricultural need here deemed sufficient to outweigh policy given detailed justification via questionnaire/emails on equipment protection and land maintenance.
Environment Policy 2
Protects AHLV character unless no harm or essential location. Siting in dip, low profile, green colour ensured no harm to landscape quality from public views.
Environment Policy 15
Requires agricultural need outweighing countryside policy, with acceptable impact, close to building groups where possible, appropriate scale/design/materials. Need accepted; siting sympathetic despite isolation (no existing buildings), low visual impact via location/height/colour.
Dark green colour
The agricultural building hereby approved shall be finished in a dark green colour and retained as such thereafter. Reason: In the interests of the character and appearance of the site and surrounding area.
Agricultural use only
The building shall be for agricultural use only. Reason: The application has been assessed on agricultural use only in the interest of protecting the countryside from unwarranted development.
Removal if use ceases
In the event that the agricultural building hereby approved is no longer used or required for agricultural use or purpose it shall be removed and the ground restored to its former condition, within 6 months of the date the use ceased. Reason: The building has been exceptionally approved solely to meet agricultural need and any subsequent retention would result in an unwarranted intrusion in the countryside.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
No highways interest
German Parish Commissioners objected due to insufficient acreage justifying the agricultural building, while DOI Highways stated no highways interest.
Key concern: acreage on the site is not sufficient to warrant such a building for agricultural use
German Parish Commissioners
ObjectionMy Commissioners object to this application as it is thought that the acreage on the site is not sufficient to warrant such a building for agricultural use and the board would like to know if the applicant owns any more land to make a building more viable.
