Officer's Report
The planning application seeks approval of the reserved matters for the erection of replacement dwelling on a site in Maughold. Approval in principle was previously granted by the approval of planning application 04/1878/A.
In terms of representations to the planning application comments have been received from Maughold Parish Commissioners, the Department of Transport’s Highways Division, the SPMCE and the Fire Safety Officer.
Maughold Parish Commissioners objects to the planning application on the grounds of its design. The Department of Transport’s Highways Division advises that the proposal has no adverse traffic impact. The SPMCE supports the planning application and considers the design to be exciting. The Fire Safety Officer recommends refusal on the grounds that the means of escape in the event of fire is inherently unsafe.
In terms of assessment, as the planning application forms the reserved matters for a approval in principle the main issue is that the proposed development meets the conditions attached to the approval in principle. After discussions with the applicant and an assessment of the planning application I am not satisfied that all of the conditions attached to the approval in principle have been met. Specifically, condition no. 4 of the approval in principle states that "The application for reserved matters must include provision for the improved access and parking arrangements to serve the new property including provision for a motor car to be driven in and out of the property in a forward gear." - the planning application does not alter the access arrangements. Accordingly, as a reserved matters planning application has to accord with the conditions attached to the associated approval in principle I have to recommend that the planning application be refused.

By reason that a reserved matters planning application must satisfy the conditions attached to its associated approval in principle it is necessary that this reserved matters planning application must satisfy the conditions attached to planning application 04/01878/A. Given that this reserved matters planning application does not include provision for an improved vehicular access to the application
site it fails to meet the requirements of condition no. 4 of approved planning application 04/01878/A. As such the Planning Committee has no alternative other than to refuse the planning application.
Whilst not a material planning consideration and therefore unable to forms a reason for refusal the applicant is advised that the Fire Safety Officer recommended that the planning application be refused on the grounds that the means of escape in the event of fire in inherently unsafe.
