In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:
Name: Heritage Homes Ltd Proposal: Creation of an 18 hole golf course with clubhouse, parking and green keepers facilities (to include renovation of existing buildings) at: Land At Middle Farm Between Kewaigue Hill, Ellenbrook Farm, Oakhill And Cronkbane Kewaigue Braddan
which was considered on 4 November 2005, subject to compliance with the conditions specified below.

Schedule Of Conditions:
- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- This permission relates to the creation of an 18 hole golf course with clubhouse and associated services and facilities, all as shown in drawings: 2274-01 to -09 inclusive all received on 10th February, 2005; 1048.04 received on 10th February, 2005; 1048.01, -02 and -3 all received on 17th February, 2005; 200 - 205 inclusive all received on 17th February, 2005; 04/441/100/005 and -006 both received on 17th February, 2005 and 012A received on 17th February, 2005 together with the Supporting Statement received on 10th February, 2005, the Manx Bat Group Report received on 24th August, 2005, the Environmental
Statement received on 3rd March, 2005 and the Ecology and Nature Conservation report received on 24th August, 2005.
- Prior to the commencement of any excavation, engineering or building operations on site, associated with this development, the applicant must have approved by the Planning Authority a phasing scheme and method statement setting out geographically how the development is to be undertaken together with the protection of the trees to be retained and the proposed haul route which should be agreed with the Department of Transport prior to the submission of such a scheme/statement.
- Prior to the demolition or alteration of any of the existing buildings on site, each must be surveyed for the presence of bats or other species protected under the provisions of the Wildlife Act 1990. If bats or their roosts are discovered, the applicant must have agreed by the Planning Authority after consultation with the DAFF Wildlife and Conservation Division a method of dealing with the same in accordance with the provisions of the Act. The applicant is encouraged to undertake demolition and alteration works outside the bird nesting season.
- Prior to the removal or alteration of any of the existing hedges, each must be surveyed for the presence of lizards and if any such, or any other species afforded protection under the Wildlife Act 1990 is discovered, the applicant must have agreed by the Planning Authority after consultation with DAFF a method of dealing with the same. The applicant is encouraged to undertake demolition and alteration works outside the bird nesting season.
- All new hedging must be constructed as traditional Manx hedges as described in Planning Circular 1/98 and with no additional planting on the southern side of new hedging to encourage habitat suitable for lizards.
- Prior to the commencement on site of any works associated with this development, the access with the adopted highway, including visibility splays all as shown on drawing 04/441/100/005 must be set out and established.
- Once the new access is in place and available for use, the existing access to Middle Farm must be closed off to vehicular traffic whilst retaining public access to the public footpath all in a manner acceptable to the Planning Authority after consultation with the Department of Transport.
- No development may be undertaken on the 18th fairway until such times as an archaeological assessment including a geophysical survey must be undertaken to ascertain the surviving archaeological potential of the land surrounding and including the mound at SC358746. If the Planning Authority is satisfied that the site is found to be archaeologically sensitive, after consultation with Manx National Heritage, the applicant must submit further proposals for the redesigning of this fairway to avoid damage to this feature and disturbance of significant and sensitive archaeological features in the form of human remains.
- There must be no discharge of surface water to the main foul sewer.
- The proposed development must be connected to the main foul sewer.
NOTE: A Drainage Connection Fee will be payable to the Drainage Authority on this development
- Prior to the erection of the proposed footbridges, the applicant must provide full details of the same together with details of the proposed ponds, reservoirs together with proposed overflows to the Middle River to the Planning Authority for its approval, following consultation with the Drainage Authority.
Note: the applicant must consult the Drainage Division of DoT and obtain written permission therefrom prior to the construction of the proposed bridges.
NOTE PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.
NOTE For water connections that comprise more than a single connection to a water main or service, or where new water mains and hydrants will be required, the applicant should contact the Isle of Man Water Authority Planning and Projects Section, telephone 695958.
NOTE It should be noted that it is an offence under Manx legislation to permit the discharge of polluting or harmful matter to any public sewers or watercourses. Appropriate measures must be taken by the developer/occupier of the premises to ensure compliance with this legislation. No discharge of fat or other food waste, which will affect the performance of the public foul sewerage system, will be permitted into the foul sewer from the proposed clubhouse. It will be the responsibility of the developer/occupier of the premises to provide satisfactory means of disposal of such waste.
NOTE No permission is hereby granted or implied to the use of the "future teaching and practice facility" shown on drawings 1048.01 and -02. Such a facility would be proposed on a high and prominent piece of land and the Planning Committee would express concern at the potential visual impact of buildings and lighting in this location.
This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.
Note 2: No works may be commenced until such time as -
- the time for requesting a review of the initial decision has expired; or
- any review of the initial decision has been completed; or
- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.
