Refusal Notice 05/01489/B
Town and Country Planning Acts, 1934 - 1991
Isle of Man Planning Scheme (Development Plan) Order 1982
Mr Chris Morris Ballacrosha House Station Road Ballaugh Isle Of Man IM7 5EJ
In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr Chris Morris Proposal: Creation of a vehicular access at: Ballacrosha House Station Road Ballaugh Isle Of Man IM7 5EJ
which was considered on 21 October 2005, for the reasons set out below.
Date of Issue: 27th October, 2005 Murray House Mount Havelock Douglas Secretary Planning Committee
Reasons For Refusal:
- The creation of a vehicular access by reason of its siting would:
i) reduce the amount of amenity space for the property to an unacceptable level which will be detrimental to the enjoyment of the property for future occupiers; and
ii) will allow for a further vehicle to be parked in front of the property which will adversely affect the character and appearance of the property to the detriment of the visual amenities of the locality.
- The creation of a vehicular access by reason of its proximity to the junction of the A10 and the A3, the available visibility and the available sight lines for any new vehicular access created would be limited and contrary to the interests of road safety. As such, it is considered that appropriate off street car parking provision could not be safely provided and that the application is unacceptable.
- This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
