Officer's Report
The application seeks approval for the change of use of a vacant retail unit in Ramsey town centre to allow its use as a tea and coffee shop serving cold snacks.
Ramsey Town Commissioners have no objection to the planning application subject to conditions regarding opening hours and restricting take away facilities. The Police Architectural Liaison Officer has requested that the opening hours of the premises are conditioned so as to control the use. The Environmental Health Officer has highlighted the various food related acts and regulations that need to be addressed.
One objection has been made on the grounds of commercial impact. I have to advise that this is not a material planning consideration and cannot form grounds for refusal.
I consider the use to be acceptable within this town centre location and recommend that the planning application be approved subject to conditions controlling its use.

C 1. The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.
C 2. This approval relates to the use of the premises as shown in the location plan date stamped the 6th May 2005 for the sale of tea, coffee and cold snacks to the public.
C 3. The premises shall not be used for the sale of food for consumption off the premises other than confectionary.
C 4. The use hereby permitted shall open be open to customers between the hours 8:30 am and 6:00 pm only in any one day.
N 1. The applicant is recommended to discuss fire precaution measures with the Fire Safety Officer.
N 2. The applicant is advised that the use of premises will be required to accord with the Food Act 1996, Food Hygiene (General) Regulations 1978, Health and Safety Act 1974 and Local Government (Miscellaneous Provisions) Act 1976. It recommended that the requirements of these various acts and regulations are discussed with the appropriate Environmental Health Officer.
