Officer’s Report
1.0 THE SITE 1.1 The application site is the curtilage of field 414532, which is land of Ballafesson Road in Port Erin. The field is now a sports pitch and dedicated hard standing car park with temporary building (containers) painted green on site. Access to the site is from the Ballafasson Road.
1.2 The temporary buildings on site are used as changing rooms for the home and away players and a referee, also storage for equipment on site. The site is used by the local cricket teams and rugby team, with the first cabin was installed in 2019. The intention is to construct a permanent building hosting changing facilities and a social amenity building and the fund raising is ongoing to facilitate this.
2.0 THE PROPOSAL 2.1 Proposed is the removal of planning condition 2 which states; "The temporary changing facilities may be retained for such purposes for a period not exceeding three years after which they must be removed and replaced with an authorised permanent building. REASON: In the interests of the visual amenities of the area".
2.2 The application is accompanied with a supporting statement which sets out the reasons why an extension to this time period is essential and how re-configuration of the temporary building will create an improved for the movement of equipment for evening training sessions.
2.3 The application seeks an extension for 5 years to June 2026.
2.3 In addition to this part of the application is to adjust the layout of the temporary facilities on site, alteration to the location of storage containers, the addition of timber cladding to the existing containers to improve the visual amenity.
3.0 PLANNING POLICY 3.1 In terms of local plan policy, the application site is within an area designated as an area of 'Open Space' with the notation of 23 linking to a development brief on Map 7 of the Area Plan for the South.
3.2 Within the written statement area 23 provides for additional residential development with accompanying recreation, amenity space and provision for an extension to Rushen Parish Churchyard. Most of this has now been implemented.
3.3 The application site is not within a conservation area. The site is not within an identified flood risk area. There are no trees within the immediate vicinity of the site.
3.2 Within the adopted Isle of Man Strategic Plan 2016, the following policies are considered to be relevant in the determination of this application:
3.3 General Policy 2 (in part): 'Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
(b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;

(c) does not affect adversely the character of the surrounding landscape or townscape; (g) does not affect adversely the amenity of local residents or the character of the locality;
4.0 PLANNING HISTORY 4.1 Planning permission was granted on 1st March 2016 with a number of conditions attached under 15/01320/B - Layout of sports pitches for rugby, cricket and other community uses, including access, car parking, prefabricated changing rooms and storage units.
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
The temporary changing facilities may be retained for such purposes for a period not exceeding three years after which they must be removed and replaced with an authorised permanent building. REASON: In the interests of the visual amenities of the area.
Prior to any construction the access shown on drawing no 1501-001C rev C dated 13/01/16 shall be constructed and the visibility splays shall remain unobstructed at a height of 1.05m thereafter. Reason: In the interest of highway safety
Prior to any construction the highway improvements shall be installed in accordance with a drawing to be approved by the Planning Authority and the visibility splays shall remain unobstructed at a height of 1.05m thereafter. Reason: In the interest of highway safety.
Prior to the occupation and use of the site the car parking and manoeuvring areas shall be provided in accordance with the approved drawing and remain free from obstruction thereafter. Reason: To ensure that the strategic plan car parking standards are met in the interest of highway safety.
This approval relates to drawings 1501-000, 1501-003 and 1501-004 received on 3rd December, 2015 and 1501-001C received on 19th January, 2016. 5.0 REPRESENTATIONS 5.1 Highways Services have commented (11/08/21) with no objection. 5.2 Arbory Commissioners commented (22/08/21) with no objection.
6.0 ASSESSMENT 6.1 With regard to the initial approval of 15/01320/B and the 5 conditions, condition 4 was discharged on 19 April 2017. The remaining conditions 3 and 4 relate to highways access, visibility splays, and parking have been undertaken, and condition 2 is the subject of this application.
6.2 The proposed re-arrangement of the containers on site would be siting the units closer together and give an equal size amount of "floorspace" but in a more compact location broadly overlapping the existing placement of some of the containers. The centralisation of these would help reduce the visual amenity and when cladded with the proposed timber and treated, would help to mitigate any views and soften the appearance of the temporary buildings. It is noted in the supporting statement that cladding is to be treated but not to paint and any exposed and visible metal surfaces such as the container doors will be painted in a neutral green colour. This can be further secured with an appropriately worded condition to protect the character of the area.

6.2 The proposed extension for 5 years would be an acceptable time frame and can be conditioned as such. It is understood the "club" has a need for a purpose built building to offer community facility and changing rooms, showers etc and is only achievable through fund raising which is continually ongoing. The 5 year period would allow for additional time to raise such funds and continue with the use of the pitches in an appropriate manner with a neutral impact on the character of the area and this application is also considered to not have any adverse impact on the surrounding residential properties.
7.0 CONCLUSION 7.1 For the above reasons, it is concluded that the proposals noted here would comply with aforementioned planning policies of the Isle of Man Strategic Plan 2016 and is recommended for approval.
8.0 INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed above who should be given Interested Person Status __
