The original application (05/00645/B) sought amendments to a previously approved extension (02/01741/B) to enclose a car port into a garage, add a garage door, new front entrance, and two side windows. The Planning Committee initially approved it on 17 June 2005, confirmed it after review on 19 August 2005 despite neighbour objections on privacy, overlooking, loss of light, and visual impact. Appellant argued the kitchen window would cause unacceptable overlooking of her front door, driveway, and garden, and the enclosed garage would harm visual appearance. The inspector found no unacceptable increase in overlooking due to the angled orientation, public footpath separation, and existing public visibility of the areas, dismissing the appeal on 14 November 2005. The Minister accepted the recommendation on 8 December 2005, confirming the approval.
Precedent Value
This appeal shows that neighbours cannot block amendments to approved schemes on privacy grounds if overlooking is over publicly visible front areas separated by footpaths. Applicants should emphasise geometry, existing visibility, and prior permissions.
