Refusal Decision Notice
Town and Country Planning Acts, 1934 - 1991
Isle of Man Planning Scheme (Development Plan) Order 1982
Mr Ashley Pettit 4 Osborne Terrace Douglas IM1 3LH
In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Social Services Division Proposal: Erection of second storey over garage and a rear porch and lift to provide additional disabled access and living accommodation, at: 30 Slieau Whallian Park St. Johns IM4 3JJ
which was considered on 15 July 2005, for the reasons set out below.
Date of Issue: 22nd July, 2005
Murray House Mount Havelock Douglas Secretary Planning Committee
Reasons For Refusal:
- The proposed conservatory would, by virtue of its height, restrict the light available to the rear yard and conservatory of the adjoining property – Number 31 – so as to unacceptably affect the amenities thereof.
NOTE The Planning Committee has sympathy with the applicant’s personal circumstances but is not persuaded that these overcome the concerns regarding the amenities of the neighbouring property. The Planning Committee recommends that the applicant considers alternative means of providing the required accommodation without adversely affecting neighbouring property.
NOTE This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
Note 1: The decision contained in this notice does not become final until:-
