Officer's Report
The application seeks approval in principle for the erection of a dwelling on a parcel of land between two dwellings in Regaby, Andreas.
The application site was the subject of a similar application through PA 00/01410/A, which was refused through to appeal on the 22nd August 2001. This current application has been accepted on the basis that there was some subsequent issues of dispute between the Department and the applicant regarding statements made at the appeal.
Setting this aside it remains that the site is not zoned for development and there is no agricultural justification for the dwelling, although the applicant is likely to highlight an approval for dwelling near to the site as setting a precedent. This dwelling was granted approval at review and, unfortunately, I can find no record to explain why the Planning Committee made this decision. However, this planning application is contrary to Planning Circular 1/88 and as such I have to recommend refusal.

The application site is neither zoned for residential development nor is there appropriate agricultural need for the proposed dwelling. Accordingly, the residential development proposed by this planning application is contrary to the Isle of Man Planning Scheme (Development Plan) Order 1982 and, in particular, the provisions of Planning Circular 1/88.
