Officer's Report
The site represents a parcel of land to the east of the crossroads of the B30 and B29 and a farm track to the north. The site has next to it two existing dwellings which are also owned by the applicants in this case.
Proposed is the principle of the erection of a dwelling on this land which is designated as Open Space on the 1982 Plan. The new dwelling will be accessed via an existing gate but involving the removal of around three trees to link into the field.
The views which have been submitted are as follows:
SPMCE who suggest that the previous proposal which effectively created a new dwelling was sufficient. This was actually for the conversion of two flats into two a self contained dwelling and extension of the other property. They also cite previous refusals for development in this vicinity (PAs 94/0004, 94/1275, 97/2070 and 00/1041). I can't find reference to 9702070 but can find 90/1855 which was also a refusal. This is slightly different in that it is infilling between two existing dwellings. Our emerging policy in the Strategic Plan suggested in the first draft that in groups of at least six dwellings, further development may be acceptable. however, this policy has been replaced with one which states clearly that such development must be taken care of in Area Plans rather than in ad hoc decision-making (such as this).
Malew Commissioners do not objection but express concern regarding visibility. Various neighbours express an interest but with no real objection. Defer for the views of the DoT.
The site is clearly not designated for development on the 1982 Plan and there have been other developments in the vicinity which have been refused (see above). I do not have the views of the DoT to hand but should add any reasons for refusal which they may have, to the refusal I recommend on land use designation grounds.

The site is not designated for development on the 1982 Development Plan Order. Rather it is designated for Open Space and where there have been decisions to refuse development in the vicinity, eg. 90/1855, 94/0004, 94/1275 and 00/1041. As such, the development of a dwelling on the site would be a departure from the development plan approved by Tynwald and would establish a precedent for further unwarranted development in this part of the Island's countryside.
