The existing painted timber sliding cash windors were removed on the 1st July 2004 and replaced with the vPVC top. Opening convenient windows as applied for this application, totally unacceptable is a registered Building especially considering the original or at least original pattern windows were removed to do so. We issued a Stop Notice on the 2nd July 2004 which was adhered to, and an enforcement notice on the 20th August 2004 which has been subsequently returned by Mrs. Bellys. The planning committee have agreed to no opening prosecution Sett Date 23/11/04. Officer's Report
This application relates to the Erin Brae Hotel which is located in a prominent position on the Queens Promenade. It is both a Registered Building and within the conservation area.
This is a retrospective application for 5 windows on the second floor to be replaced with white upvc double glazed top hung windows.
The conservation officer has stated that the existing painted timber sliding sash windows were removed on the 1st July 2004 and replaced with those now being applied for, and that they are totally unacceptable in a registered building (especially when original patterned windows were removed to do so). A stop notice was issued on 2nd July 2004 which was adhered to and an enforcement notice on the 24th August 2004. The planning Committee have agreed to pursuing prosecution.
The windows are contrary to policy. the building is registered and in a conservation area, and any original windows should preferably have been repaired and if this were impracticable then the
replacement windows should have been the same as the originals in all respects, including the method of opening, materials and detailed design. There are no exceptional circumstances in this case to justify a relaxation of the policy.

The building is a Registered Building and within a conservation area and the installation of upvc top opening casement windows to replace painting timber sliding sash windows would be out of keeping with the original design of the building, would reduce the architectural interest of the building, and would detract from the architectural interest and attraction of the conservation area.
