THE APPLICATION SITE 1.1 The application site is the residential curtilage 9 Third Avenue, Onchan which is a mid- terraced property situated to South end of the Third Avenue Cul-De-Sac.

1.2 To the rear of the property is an access road which goes all the way around the rear of the properties within Third Avenue and connects to a rear access which goes behind the properties along School Road and joins up to the rear access road behind Second Avenue.
1.3 There is currently one parking space within the rear of the property.
THE PROPOSAL 2.1 The application seeks approval for the demolition of an existing rear structure and erection of a single storey extension to the rear.
2.2 The proposed extension will measure approximately 5m by 2.3m, with an overall height of 3.6m. The roofing will be composite slate and the rainwater/windows & doors will be uPVC. The extension will be painted render to match the existing property.
PLANNING HISTORY 3.1 There are no previous planning applications on the site.
PLANNING POLICY 4.1 The site lies within an area zoned as "predominately residential" and within an area zoned as "CTA 5" on the Area Plan for the East, Map 6, Onchan. The site is not within a Conservation Area, Area of High Landscape or Scenic Significance nor in a Flood Risk Zone.
4.2 In terms of the Isle of Man Strategic Plan 2016, the key policy for this application is General Policy 2, which states in part, "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; c) does not affect adversely the character of the surrounding landscape or townscape; g) does not affect adversely the amenity of local residents or the character of the locality;
REPRESENTATIONS 5.1 Highways Division have considered the application and state, "After reviewing this Application, Highway Services find it to have no significant negative impact upon highway safety, network efficiency and/or parking. The applicant is advised that a licence may be necessary for the positioning of equipment and materials in the highway." (01.07.21)
5.2 Onchan District Commissioners have considered the application and state, "The commissioners would recommend that the application be Approved for planning purposes only." (14.07.21)
ASSESSMENT 6.1 The main issues to consider in the assessment of this planning application are:
6.2 CHARACTER AND APPEARANCE 6.2.1 The proposed extension is a single storey rear extension which will not come out any further than the already existing small extension with this in mind the principle of the extension is acceptable. The materials and design is acceptable and due to there already being an extension such as this one (with slight different details) on No. 7 Third Avenue, the proposed extension will fit within the existing streetscene.
6.3 NEIGHBOUR AMENITY 6.3.1 With regards to neighbouring amenity of the proposed extension there is the possibility that there could be potentially more of a loss of light to the rear garden than what is already

existing. When looking at shadow calculators the loss of light would be minimal and during the morning, as such there should be a minimal effect on the neighbouring property to the West.
6.4 OTHER MATTERS 6.4.1 When looking at the addition of the proposed extension, it is relevant to note that the car parking space for the property is in the rear. Whilst the proposed extension is large in width side, it does not protrude and further than the already existing small boundary extension and as such there should be no effect on the existing parking space.
CONCLUSION 7.1 On balance and for the above reasons the proposal is considered to comply with General Policy 2 of the Isle of Man Strategic Plan 2016 and therefore acceptable.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed above who should be given Interested Person Status __
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
