Scope of approval
This approval relates to the installation of a wood chipping machine on the site as an amendment to PA 02/2365 which granted approval for the continuation of the excavation and infilling of the sand pit until the final phase is complete including alterations to the access arrangements. This approval relates to the location plan (number JCK 01/04) but permits the works only as detailed on drawing number 03F04a submitted on 27th September 2004.
Time limit
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Permitted waste types
This approval permits the reception, sorting and chipping of waste plant matter including wood and bark and storage of such, pending removal off site for recycling elsewhere.
Temporary use and restoration
This machine shall be utilised alongside the sand extraction and infilling operations approved under PA 02/2365. The machine shall be removed prior to completion of the final phase of infilling to permit the ground levels to be formed in accordance with drawing number 05B03 ay, approved under PA 02/2365. Only waste from the construction industry shall be deposited as backfill and that waste shall only contain the following types of material(s): 'Soil, clay, sand, stone, brick, concrete, ceramic materials, slate, glass, plastics, metals all of which shall be non-leachate forming materials'.
Noise limits
The rating level of the noise emitted from the wood chipping plant, shall not exceed LAeq, 1 hour - 40 dB daytime as measured at the boundary of any adjacent residential premises. The rating level shall be measured and calculated in accordance with BS 4142:1997 'Method for rating industrial noise affecting mixed residential and industrial areas.'
Operating hours
The site shall only be operated between the house of 0800 to 1700 Mondays to Fridays and 0800 to 1200 Saturdays. The site shall not be operated on Sundays or Bank Holidays. These limitations shall apply to operations on site. For the purpose of this condition operations shall include the extraction, movement, grading of sand and any associated delivery of sand/gravel to the site and delivery, movement, deposit, levelling, compacting, and covering of waste materials as well as the chipping of waste plant matter.
No burning
No waste shall be burnt on site.
Site restoration
Following completion of the final phase of infilling, the site must be topped with subsoil and then top soil and returned to agricultural land.
Access restoration
On completion of the infilling and top soiling the temporary access must be closed off and a hedgerow/sod bank reinstated with the same profile as the adjoining hedgerow.
Dust suppression
Whenever necessary site roads, incoming loads and waste awaiting deposit shall be sprayed with water to suppress the emission of dust, and in any event shall be so sprayed if requested by officers of the Department of Local Government and the Environment.
Highway protection
No water or contaminates from the site shall be permitted to flow or be tracked by vehicle wheels onto the highway.
Dr RJ Hanks from Medehamstede, Lhergy Dhoo, submitted two representations objecting to planning application 04/01180/B for recycling wood into woodchips and siting additional plant, citing health risks, accident risks, environmental risks, and non-compliance with previous planning conditions.

Objectionthe potential fine particulate matter from a wood chipping mill is much smaller in size and so less likely to be effectively filtered biologically this could increase the risk of chronic obstructive pulmonary disease and asthma; There has been a multiple fatality RTA on the corner at the entrance of the proposed site; Previous approvals have stated that all waste on the site should be 'non leachate forming materials' of which wood and other vegetable matter is definitely not; The approval for use of the site for the purpose of chipping would effectively exclude its' reinstatement to its previous agricultural appearance contrary to all previous planning conditions

ObjectionMy original objections to the application are not influenced by the amendment to the application; I do not feel that these points can be disregarded without formal testing by a reputable environmental health laboratory; I would like confirmation of a time frame for both exhaustion of sand excavation and an assurance that this will not be delayed to obtain maximum duration of use of the site for other uses ie. Chipping etc.; the backfilling should have a schedule so that materials are not merely bought to the site, processed, and removed again such that little or no land filling occurs
Conditions requested: formal testing by a reputable environmental health laboratory on particulates inhalation, noise pollution, effect on local watercourses; confirmation of timeframe for exhaustion of sand excavation; assurance that sand exhaustion will not be delayed to maximise chipping use; backfilling schedule to ensure actual land filling occurs
