In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby APPROVE the application made by you

Proposal: Change of use from retail to a coffee/tea shop selling hot and cold food for consumption on the premises and takeaway, with provision for outside dining

at: 5 Windsor Road Douglas IM1 3LD

Which was considered on 30 September 2004, subject to compliance with the conditions specified on the attached schedule.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -

• the time for requesting a review of the initial decision has expired; or
• any review of the initial decision has been completed; or
• the time for requesting an appeal in relation to the decision has expired; or
• any appeal has been completed.

1. The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.

1. This approval relates specifically to the proposals as set out on the submitted application form; no approval is granted or implied to cooking or frying.

1. Any alterations to the external appearance of the building, including the erection or display of new signage must form the subject of a separate application to the Committee.

1. Prior to the use of any external space for seating, there must be submitted to and approved by the Committee a plan showing the extent of such space and the general layout thereof.

1. The external seating area may be used as such only between the hours of 0800 and 1800; the coffee/tea shop may not be open after 2200 on any day.

NOTE There should be consultation with the Fire Safety Department with regard to fire precautions.

NOTE The applicant is advised to consider the recommendations of the Disability Access Officer, a copy of which is attached hereto.

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
