The site comprises the curtilage of a mid-terraced building in Clifton Terrace. The application seeks approval to change the existing tourist flats into permanent flats. Flats 3 and 4 are entirely within the rear annex. There is no parking provision.
The application indicates that the flats have been used as permanent flats for 12 years. I have asked John Howie to confirm his judgement (as cited by the applicant). Subject thereto, I recommend approval, since, in the circumstances, enforcement is unlikely to succeed for, indeed, be sanctioned.

N 2 . The applicant should arrange for inspection of the flats by the Environmental Health Inspectorate with a view to Registration in terms of the Housing (Flats) Regulations 1982.
