In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the application made by you on behalf of:

Proposal: E tension to existing garage store, creation of a pedestrian access to Marathon Road and upgrading of forcourt
at: Garage Adjacent To 21 Victoria Terrace Douglas IM2 4EX
which was considered on 20 February 2004, for the reasons set out in the attached schedule.

Reasons For Refusal
Application Ref No: 03/01754/B
- The proposed works would serve to perpetuate and intensify a non-conforming use which has an adverse effect on
(a) the enjoyment of the surrounding residential area as such; and (b) the setting of Victoria Terrace, which is Registered as a group of buildings of special architectural interest.
- The proposed doorway on to Marathon Road would give rise to waiting and parking on Marathon Road, adding to existing congestion.
- This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
