ON APPEAL: PA03/1473 – A. E. Corkill Limited – Erection of an office development with parking and associated works to replace existing offices and gymnasium, 39 Finch Road, Douglas
I refer to the recent appeal hearing in respect of the above planning application.
In accordance with the provisions of paragraph 7(5) of Schedule 1 to the Isle of Man Planning Scheme (Development Plan) Order 1982, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.
The Minister has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that, subject to the conclusion of a satisfactory legal agreement concerning the provision of fourteen off-site parking spaces, the appeal should be upheld. Since such an agreement has now been formulated, the Minister has directed that the Planning Committee's decision to refuse permission should be reversed, and that the application should be approved subject to the conditions as set out in the schedule to the report. Formal notice of approval is attached.

In pursuance of his powers under the above Acts and Order the MINISTER for Local Government and the Environment, following report by the appointed person, does hereby APPROVE the application by A. E. Corkill Limited Erection of an office development with parking and associated works to replace existing offices and gymnasium, 39 Finch Road, Douglas, subject to compliance with the conditions specified on the attached schedule and numbered 1 to 7 inclusive.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, byelaw, order or regulation.

- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- The offices hereby permitted shall not be occupied until the hardstanding forming the turning area and the on-site parking spaces shown on the approved plans has been completed, and the hardstanding area and parking spaces shall be kept available and used for none other purpose.
- No water or contaminants shall be permitted to flow or be tracked by vehicle wheels onto the highway.
- No development shall take place except in accordance with a construction method statement which shall be submitted for the written approval of the Planning Committee.
- The development shall not be occupied unless provision has been made for the storage and collection of refuse in accordance with a scheme to be submitted for the written approval of the Planning Committee.
- No development shall take place except in accordance with details or samples of the external finishes which have been submitted to and approved in writing by the Planning Committee.
