ObjectionThis application is not acceptable. The land is a garden and is not zoned for residential use.
The original application (03/01485/A) for approval in principle to erect a dwelling on former garden land between The Rhullick and Holly Bank, Narradale, Sulby was refused by the Planning Committee as the site is outside zoned residential areas and contrary to countryside protection policies in Circular 1/88. The appellant argued the site is within a group of existing dwellings, well-screened, not agricultural, with acceptable access, compliant with draft Housing Policy 5 for infill, and for family use. The council defended the refusal citing policy to keep countryside free from non-agricultural development, risk of precedent, supported by third parties. The inspector acknowledged screening and access but found the development would consolidate sporadic rural development, harming landscape character contrary to Circular 1/88, and personal circumstances insufficient to override policy harm. The appeal was recommended dismissed on 17/7/04.
