We note that there appear to have been no previous planning applications in respect of this site and its use as a motorbike scrambling circuit, and that since the track already exists, this application is therefore retrospective.
The field concerned is situated in an Area of Scenic Significance which is visited by walkers and cyclists amongst others amenity users. The motorbike scrambling activity is adjacent to and highly visible from Marine Drive, and by its very nature is visually intrusive. Despite the applicant's assertion that there has been 'very little engineering work' the appearance of the field has been extensively altered as a result of the recent creation of track and subsequent scrambling events.
Should the Committee be minded to approve the application we would suggest that the applicant be required by condition to

Please find comments from Freshwater Fisheries as follows:-
The proposed works must not cause any adverse impact in terms of pollution or disturbance to the nearby watercourse and the bankside vegetation, which may provide cover for the fish populations present in the stream.
An 8 metre buffer strip between the development and the edge of the river should be retained to conserve and protect wildlife.
No part of the soakaway system must be situated within 10 metres of any ditch or watercourse, to avoid pollution to the adjacent watercourse.
The works must not cause an adverse impact in terms of pollution or disturbance to the nearby watercourse or the bankside vegetation (both during construction and after), in particular there must be no run-off to the stream which may cause sedimentation or siltation of the instream habitat.
The proposed track must be no closer than 8 metres to the stream and must not cross the stream at any point.
In order to protect the river and the in-stream fish populations, there must be no works within 8 metres of the watercourse and the works must not cause an adverse impact in terms of
pollution or disturbance to the river or any bankside vegetation. There must be no untreated surface run-off to the river.

Because of the adverse ecological, flood defence and other effects that are likely to arise from the culverting of watercourses, Freshwater Fisheries have some concern over this application.
The stream is already extensively culverted further downstream and flooding problems have arisen previously. For this application, in order to avoid an increased risk of flooding, it would be advisable to request that the original channel dimensions, gradient and streambed be retained. During construction work, adequate precautions must be in place at all times to avoid pollutants entering the stream.

It would be helpful if you could provide a little more information on the proposal so that the Planning Committee may obtain a full and proper understanding of what is proposed.
Is the track to be retained at present or will more earth moving be proposed or undertaken, for example to move the jumps around within the site, to change the course itself or to heighten or decrease the jumps already in place?
Where will vehicles park when persons are visiting the site? Is the site proposed for use for just your personal use or will events be held there, if so, what size of event and how often? When events are to be held, where will visitors park? Are there to be toilet facilities?
Are there likely to be problems of oil leakage or other problems of spillage which could adversely affect any existing water courses? If so, are there steps which you could take to overcome these concerns? i would be grateful if you could advise me of your response to the above points whereupon the planning committee will be in a better position to assess your proposal.

I don't know if you've come to this application yet. If you haven't you ought to make a site visit. The site has been used off and on for scrambling - official and unofficial for several years. However recently considerable earth moving has taken place despite the suggestion in the application that this is not the case, easily visible on site, and the use has become more intensive and more frequent.
The key consideration in determining whether planning permission was required is really whether the site could be used for the approved or
legitimate use - Open Space and/or Agriculture in this case. Clearly it cannot be used for agriculture now that the course is established and there is nothing to graze, hence requiring the application. I will ask the applicant to provide more information regarding use of the site - frequency and intensity of use, parking, oil and fuel storage and disposal. I'll let you know when I hear back.

Hi Sarah,
I spoke to a couple of guys from the ACU today and asked them about this site - I believe the stream is mostly slab and bedrock and therefore of limited importance in terms of fish populations, therefore I have no problem with the application. However, could you add a note in your response to let them know that they are welcome to contact either myself or John Ballard should they ever have any concerns regarding any adverse effects to the watercourse?

I understand that you have submitted views on the above application for the scramble track on Douglas Head and that you are concerned that the use does not adversely affect the adjacent watercourse. The creation of a scramble track at this site has resulted in the loss of semi-natural and natural habitats. including dry dwarf shrub beathland, recorded in the DAFF Phase 1 Habitat Survey. Heathland is an internationally rare habitat, and the British Isles and north-west Europe hold most of the world's Atlantic dwarf shrub heathland. Common lizards, protected by the Wildlife Act 1990, are frequently found in this habitat, and have been recorded on the adjacent Marine Drive. We strongly recommend that the remaining areas of heathland within this field are retained and the scramble track is permanently restricted from these areas. The enclosed map shows the approximate location of the main area of heathland.
Runoff from the bare earth tracks will carry heavy loads of sediment, and has the potential to be seriously damaging to the local environment. Runoff from tracks must not be channeled directly into the Pigeon Stream, instead it should be disposed of via soakaways. Allowing natural vegetation to regenerate between the course tracks will help to trap and reduce the sediment. An 8 meter buffer zone of natural vegetation should be left/ allowed to develop adjacent to the road to reduce runoff from the site reaching adjacent areas of sensitive vegetation.

Additionally the scramble track should not be allowed to extend any further to the east to protect the Pigeon stream and the areas of marsh and wetland vegetation associated with it.

The Commissioners object to the application due to the following reasons:
That the application is contrary to the planning policy contained within the Braddan Local Plan, in particular Policy 13.3 and 13.4 on page 28, and furthermore by Policy 14.13 and 14.14 which state:
14.13 It is recognised that it is essential to protect the coastal areas of the island and this policy will be vigorously applied in the Braddan Parish District
14.14 No additional development on the coastal areas will be permitted with the exception of:
i) Port Soderick, subject to a detailed study
ii) The re-opening of Marine Drive if this is shown to be practical.
In addition to the above, the Commissioners believe that whilst the development has already been carried out, the impact not only on the environmental issues but in particular the visual impact is significant and is not only detrimental from the views from the Marine Drive, but also views of the coast from the sea.
The Commissioners whilst noting the applicant has referred to the use of the land for his son, believe that the extent of development and engineering works far exceeds what could be defined as "an occasional use for an individual". The Commissioners are aware that the site and scramble track was utilised recently for an international event and has been increasingly used since this event.
The use of the site for the above event resulted in the applicant requesting a road closure order for the Marine Drive, and this indicates that the site cannot be used without a road closure order.
Conclusion
The Commissioners would therefore strongly recommend to the Planning Committee that this application should be refused.

I refer to the above application which is presently being deferred pending the receipt of further information from yourself which was requested by me on 1st August, 2003.
I visited the site yesterday and walked around the perimeter of the track and around the track itself. I have also had the benefit of the views of the Department of Agriculture, Fisheries and Forestry Agriculture and Wildlife Division and I attach their views for your information.
My visit and the Department of Agriculture. Fisheries and Forestry's views throw up a number of issues and it would be helpful for you to try to resolve some of these concerns before the Planning Committee considers the application. As I explained on the telephone to you, your application may stand a better chance of approval if the track were to be used by a wider number of persons other than just yourself and your son as the visual impact which has been created through the works which have been undertaken is unlikely to be offset by the benefit accruing if it is only one or two people who will be using it. However, if the track is to be used by groups of people and possibly for events, this may give rise to noise nuisance, although we have had no objections to the application on this basis. I may consult our Environmental Health Section in this respect prior to the consideration of the application by the Planning Committee.
The Department of Agriculture, Fisheries and Forestry's concerns appear to relate to the protection of those parts of the site which accommodate dry dwarf heathland, protection of the Pigeon Stream and proper control of water within the site. In respect of the heathland, this
could be taken care of simply by fencing off the relevant areas which could be identified on site by the Department of Agriculture. Fisheries and Forestry's Officers.
On my visit I noticed that there is an area of standing water filled presently with brownish water. Where does this water come from and what has caused its brown colour? I also noticed that the Pigeon Stream has been interfered with towards the north eastern edge of the site where stone has been deposited to as to terrace the stream. Was this undertaken by yourselves in connection with the preparation of the site for the recent event? I couldn't see any obvious route out of the area in which the water was collecting, although the stream seemed to continue quite happily some distance further down. The Department of Agriculture, Fisheries and Forestry have suggested that water run off should not be permitted to run off into the stream and the course looked very close to the stream at this point with any machines leaving the jump actually landing in or close to the stream itself. If permission is to be granted the course may need to be altered at this point to provide a greater distance between the course and the stream - the Department of Agriculture, Fisheries and Forestry would recommend 8 metres and preferably some fencing erected and protection of the stream provided from those using the course.
The Department of Agriculture, Fisheries and Forestry also recommend that a buffer of 8 metres of vegetation should be retained between the course and the road to provide an area into which water run off could be absorbed. This could be provided by simply fencing off an area and preventing access into it in the appropriate location.
I would be grateful if you could provide a response to the above information. It may be helpful for the Planning Committee and those interested in the application to provide a more detailed plan of the course - showing where the course will be used including the protective measures outlined above.

RE:- CHANGE OF LAND USEAGE AT DOUGLAS HEAD DEAR SIR / MADAM.
As Chairman of the Isle-of-Man Schoolboy Motorcycle club, I am writing to support Mr D. Pearce in his application to get change of land useage at Douglas Head into a motorcross track. Mr Pearce is well know on the island for his unrewarding efforts and interest that he applies to schoolboy motorcycling.
On several accasions he has kindly donated the use of this land for schoolboy motorcross events. At present we have a membership of 60 rider's with their ages ranging from between 6 to 15 , as you are aware the availability of land for this type of sport is increasingly difficult to come by and at present we do not have a venue of our own. At the moment we rely on local clubs to support us .Mr Pearce has extended an invitation for the I-O-M-Sboolboy Motorcycle club to use the Douglas Head track at certain times.
It is so rewarding to watch children of these ages competing against each other and learning values such as competitiveness and discipline that this type of sport can bring, so could you please take this into account when making your decision.

This approval relates to the principle of the use of the site for motorcycle scanning together with the creation of the track and associated manning, cropping, access arrangements, and landscaping.

The site represents around 17 acres (6.9 ha) of land situated on the northern side of the Morne Drive. The site slopes upward from the woodlands, presently characterized by large mounds of earth, bore motorcycle tracks with some grass and heat retained largely in the south, upstream of the site.
The site has been used in various ways for informal and infrequent formal screening since at least 1990. Actual photographs before then (see enclosed) show. Geomorphology of the place in various different locations on this treachard. Most recently, an international event was held in April this year. Informal pestering took place since.
The application is in principle, detail and for storage of use, according to the form.

Approve/Refuse
Upon wildlife, the Reference re appearance of the area, treachards and the amenities of the Morne Drive aspect of the Reading Fenton football and residents.
The site is designated as Open Space & NIV on the 1990 Reddon local plan. In the emerging zone, it is also identified as an area of ecological sensitivity, reiterated in DP. Seumann's letter of 31/7/03 which refers to lizards. PTO.
This impact could be mitigated by protecting the remaining areas of drung shamblard and avoidance of people gaining access to it for pering or scambling.
The Pigeon Stream runs along the eastern side of the site. It has been interfered with relatively recently by the deposit of stones although this has not been attempted to fix the flow of the river and it appeared clear and uncontaminated downstream. There is also a large pond of brown still water within the track circuit where this comes from and goes to is unknown (see my letter of 12/3/03 to which I have had no reply). DAFF has recommended the provision of an 8m buffer zone of natural vegetation between the track and the stream. This would necessitate re-forming the circuit at some points in the north eastern corner.
The steelocks dreadful at the moment due to scaffolding (marshalling points thick), pallets, poor quality picker fencing and scattered patches of bare track. Some of this could be improved but it will always, if used, be something other man natural headland/hectinland. When the track is in use however, its appearance is probably improved as it appears as it is in use.
Access to the site is solely from Douglas Metal. No objection has been received from DOT or any residents of Head Road on the basis that this is unacceptable.
Access into the site is good although most people attending events as spectators will per on more drive.
The amenities of the footpath are affected in terms of both the appearance of the site and when events
APPLICATION No. acknowledging the public difficulties in getting past but this is the different from incinerances from allies and other motor sports events and are infrequent. The frequency of the events can be controlled by condition (see PA 01/0098). Whilst the apartments at Douglas Head are cleaned half a mile apart, carbon and iron not aware of equations needs after the event is spent.
In summary: the concerns which have been asked regarding water pollution and wildlife, access can all be overcome. What cannot be overcome is the change in appearance of the site. The site is not designated for development or even recreational use on the development plan, but these circuits arely use (see the Kimmeragh, Ballagarr-aghys and Krock fray circuits) and are almost always in rural areas. Motor sport is generally encouraged on the land, and this is to be supported, this site is relatively out of the way and need not be delivered to wildlife. The application is deficient in many respects and should not be approved without considerable control through conditions.
The PC may resolve to do so if the following:
The question of enforcement should be considered if
option it is pursued. The site was clearly seen used in some form since 1990. The intensity of use may have increased recently although endeavour of this would be hard to find. There may be a difference between practising and events.
I'm not persuaded from the endeavour bot in the application or what was happened on site, that the impact is justified by the few times it is used and by whom.

I, the site is designated as Open Space/Agro Division both the Bacton Plan adopted by Tyward in 1990 and the emerging Bacton Plan produces the subject of a public inquiry in June 2005. In both plans, the area is also designated as berey of High Leakage, Valuable Sewer Significance. As such, the approved use is inconsistent with this designation and has had a significant impact on the character and appearance of the area, as in most parts of the area, with the effective use of undisturbed appearance. This area is the area of the area that is out of keeping with the effective use of undisturbed appearance.
Note: As this application has been refused, all further use of the site for non-device sampling must be made. In addition, the tract on which sampling has been made must be controlled by the maps and modeling removed and any fencing, scaffolding, and outlets which have been deposited, must be removed. This must all be completed within
