The site is the curtilage of an existing terraced property situated at the eastern end of Ballamaddrell - a residential estate to the south of Station Road at the eastern end of Port Erin. The property is a single storey dwelling with no frontage to the highway, a relatively long garden to the west extending up to a pedestrian footpath and a shorter garden to the east which has a footpath to the east leading from a communal garage block and parking area.
The property adjoining to the north has an existing rear annex, extending out by 2m and built right up to the boundary with the application property.
The site lies within an area designated on the Port Erin Local Plan of 1990 and the draft Southern Area Plan of 2011 as Residential.
Proposed is the construction of a conservatory on the eastern elevation, built up to the existing annex on the rear of the adjacent property. The conservatory will have an angled front, angled away from the extent of the adjacent extension and projecting out by a further 700mm at the longest extent of the conservatory. The structure is to be just over 3m wide.
The conservatory will have a dwarf wall to match the finish on the dwelling, a upvc frame and roof.
General Policy 2 is the appropriate policy to be applied in this instance:
"Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
a) is in accordance with the design brief in the Area Plan where there is Development which is in accordance with the land use zoning and proposals in the appropriate such a brief; b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the space around them; c) does not affect adversely the character of the surrounding landscape or townscape; d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; e) does not affect adversely public views of the sea; f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; g) does not affect adversely the amenity of local residents or the character of the locality; h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; i) does not have an adverse effect on road safety or traffic flows on the local highways; j) can be provided with all necessary services; k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and n) is designed having due regard to best practice in reducing energy consumption."
In this instance the critical parts are those relating to the impact on the appearance of the property and the impact on the amenities of those in adjacent property.
PLANNING HISTORY No planning applications have been submitted in respect of this site. REPRESENTATIONS Port Erin Commissioners indicate that they do not oppose the application.
The conservatory will be built up against an existing structure associated with the adjacent property and will thus not result in any adverse impact thereon. The conservatory will extend slightly further out than does the extension on the rear of the adjacent property but with no significant or negative impact on the outlook or amenities of those in the neighbouring property.
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the erection of a conservatory as shown in drawings 4605/01, 4605/02 and the site and location plans all received on 21st March, 2011.
